These Terms of Service (the “Terms”) are a binding agreement between you and Systema Obscura, a trade name of Corpus Obscura Inc., a Florida corporation (“Systema Obscura,” “we,” “us”), governing your use of the Strongpoint: Pixel Defense mobile game and any related software, updates, and content (the “Game”).
By downloading, installing, or using the Game, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Game.
1. Eligibility and age
You must be at least 13 years old to use the Game. If you are under the age of majority where you live, you may use the Game only with the consent of a parent or legal guardian who agrees to these Terms. The Game is not directed to children under 13, and we do not knowingly collect personal information from them.
2. Licence to use the Game
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Game for your own non-commercial entertainment. This is a licence, not a sale. We and our licensors retain all right, title, and interest in the Game.
3. Ownership and intellectual property
The Game and all of its content, other than content you create, are owned by Systema Obscura or our licensors and are protected by copyright, trademark, and other laws. “Strongpoint: Pixel Defense,” “Systema Obscura,” and our logos are our marks. Except for the limited licence granted to you, we reserve all rights.
4. Ads and the free version
The Game is free to play and, in its free version, shows advertising provided by Google AdMob, including an optional rewarded ad you can watch to receive in-game deploy funds. Advertising is handled as described in our Privacy Policy. Where consent is required (for example in the EEA and UK), the Game asks for your ad-consent choice before ads load, and you can change it later in the Game’s settings.
5. Premium subscription and purchases
The Game offers an optional premium subscription that removes the ads shown in the free version and may include early access to features. Subscriptions are sold and billed through Google Play Billing and auto-renew until cancelled. You can manage or cancel a subscription at any time in your Google Play account; cancellation takes effect at the end of the current billing period. Google, not Systema Obscura, processes your payment. We do not receive or store your payment card details. Purchases are final except as required by applicable law or Google Play’s refund policy, and prices may change.
6. Virtual items
In-game items and currencies, including cash, salvage, command, and deploy funds, are a limited, personal, revocable licence to use a feature of the Game. They have no monetary value, cannot be redeemed for real money, and cannot be transferred or sold. We may create, modify, remove, re-balance, cap, or expire virtual items at any time, including for game balance. Because progress is stored on your device, your balances may be lost if you uninstall the Game, clear its data, or lose your device.
7. Your creations
The Game lets you build custom maps and layouts in Creative mode (“User Content”). You keep any rights you have in your original creations. Currently User Content is stored on your device only and is not uploaded to us or shared with other players unless you choose to share it yourself. If we later add online sharing, you grant us a worldwide, non-exclusive, royalty-free licence to host and display your shared User Content solely to operate and promote the Game, and additional terms may apply. You are responsible for ensuring your User Content does not infringe anyone’s rights or violate Section 8.
8. Acceptable use
You agree not to, and not to help anyone else to: reverse engineer, decompile, or modify the Game except where that restriction is prohibited by law; use cheats, bots, hacks, or unauthorised third-party software, or exploit bugs for unfair advantage; copy, sell, rent, or otherwise commercialise the Game or its content; remove or alter proprietary notices; create or share User Content that is unlawful, infringing, or objectionable; interfere with or disrupt the Game or circumvent its security; or use the Game for any unlawful purpose.
9. Updates and availability
We may release updates and new features and may change, suspend, or discontinue the Game in whole or in part at any time. Some updates may be required for continued use. The Game is provided on an “as available” basis and we do not guarantee it will always be available, uninterrupted, or error-free.
10. Privacy and data
The Game has no accounts and stores your settings, progress, and creations on your device. It uses Google AdMob for advertising and Google Firebase Analytics for anonymous gameplay analytics, which you can turn off in the Game’s settings. How we handle data is described in full in our Privacy Policy, which is incorporated into these Terms by reference. Uninstalling the Game or clearing its data permanently deletes your local progress and creations, which we cannot recover.
11. Third-party services and stores
You obtained the Game from Google Play, and your use is also subject to Google Play’s terms. The Game includes third-party materials such as sound effects, music, and open-source components under their own licences, acknowledged in the Game under Settings, Legal.
12. Disclaimer of warranties
To the maximum extent permitted by law, the Game is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Game will be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of these may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, we and our officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to the Game or these Terms, under any legal theory, even if advised of the possibility. Our total aggregate liability will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD $10.00. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Systema Obscura and its officers, employees, and licensors from any claims, damages, liabilities, and expenses, including reasonable legal fees, arising out of your misuse of the Game, your violation of these Terms, your User Content, or your violation of any law or third-party right.
15. Termination
These Terms apply until terminated. Your licence terminates automatically if you breach these Terms. We may suspend or terminate your access if you violate these Terms or the law, or to protect the Game or other players. You may terminate by uninstalling the Game. Sections that by their nature should survive, including Sections 3, 6, and 12 through 14, survive termination.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, for example in-app or on this page, and update the date above. Your continued use of the Game after changes take effect means you accept them.
17. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, and excluding the U.N. Convention on Contracts for the International Sale of Goods. Nothing here removes the protection of mandatory consumer-protection laws of your country of residence. Before filing any claim, you agree to try to resolve the dispute informally by contacting us at administratum@systemaobscura.com.
